Terms of Service

Crash is a website (and soon a phone app) for student housing near the University of Miami, run from Miami, Florida. In these terms, "Crash", "we" and "us" mean the people who run it, and "you" means anyone who uses it.

By using Crash you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Crash.

You must be at least 18 years old. You need an account to post, send requests or chat; browsing needs none.

Posting a place is for people at the University of Miami: you need a confirmed miami.edu email address, or a document we have read that shows you are part of UM (the Privacy Policy lists what you may send). Finding a place and sending requests need neither.

One account per person. Use your real name or the first name people know you by, and keep your email address working so you can sign in. You are responsible for what happens under your account, so do not share your sign-in codes with anyone.

Crash is not affiliated with, endorsed by, or run by the University of Miami.

Crash lets people list places to rent, sublet, or take over, and lets renters and roommates find them, send requests, and talk once a request is accepted.

Crash is not a real estate broker, agent, landlord, or property manager, and is not a party to any lease, sublease, or agreement between users. We do not hold rent, deposits or any other money, and we do not take a commission. Any agreement you make is between you and the other person (section 4).

Crash is free. We do not charge renters to browse or contact listers, and we do not charge listers to post. If that ever changes, we will tell you before it applies to you.

We do not run background, credit or income checks, and we do not inspect places. When a page says something was checked (for example "UM email verified", "UM affiliation document reviewed" or "Listing authorization reviewed"), it means only that exact thing, at the time it was checked: that a person controls a miami.edu inbox, that a person at Crash read a document with that person's name and the University of Miami on it, or that a person at Crash read the documents a lister sent. "UM verified" means one of the first two. It is not a promise about a person, a place or a deal. Always see a place, in person or on a live video call, before you pay anything.

Crash introduces people. Everything after that is arranged directly between you and the other person, outside Crash: viewings, the lease or sublease, rent and deposits, keys, and moving in.

The steps on a match (viewing, agreement, move-in) are a shared checklist for the two of you. Ticking a step does not create, approve, sign or record an agreement, and Crash does not check that it happened.

Files you share in a match are for the other person only. Crash does not open, review or approve them, and does not decide whether a document is real, valid or enough.

Crash does not draft or sign leases, and does not take, hold or pass on rent, deposits or any other payment. Nobody from Crash will ask you for a payment. Before you sign anything, read the “Before you sign” checklist on your match: it is general information, not legal advice, and you should consider having a qualified professional review an agreement before you sign it.

Only list a place you have the legal right to rent out: you own or manage it, or your lease or your landlord allows you to sublet or transfer it. We may ask for proof, and we may keep a listing hidden or take it down until we have it.

Describe the place honestly: real photos of that place, the dates it is available, the full monthly price including any required fees, and any one-time costs. No bait prices, no places that are not available, no listing the same place more than once.

The exact address stays private until you accept someone's request. Do not put it in your title, description or photos, and leave house numbers and street signs out of the entrance photo.

Your listing comes down by itself at the end of the date you pick for when you need it filled. You can change that date, mark the place taken, or remove the listing at any time from My listings.

Housing discrimination is illegal. You must follow the federal Fair Housing Act, the Florida Fair Housing Act, and the Miami-Dade County Human Rights Ordinance. Do not refuse anyone, set different terms, or say who may or may not apply because of race, color, religion, national origin or ancestry, sex, pregnancy, disability, familial status, age, marital status, sexual orientation, gender identity or expression, source of income (including housing vouchers), or any other trait the law protects.

In a shared place you may describe who lives there now (for example "all-women household"). That describes the home; it is not a rule about who may apply. If you are not sure whether something is allowed, describe the place, not the people you want.

We remove listings and messages that discriminate. If you think a listing discriminates against you, report it on Crash, and you can also contact HUD.

Do not: post fake or misleading listings; pretend to be someone else, or to be Crash or the University of Miami; ask for money for a place someone has not seen, or ask for payment by wire, gift card or cryptocurrency; harass, threaten or bully anyone; post sexual content, hate speech, or anyone's private information; send spam or the same message to many people; or use Crash for anything illegal.

Do not copy listings or profiles off Crash with bots or scripts, get around our limits, try to break or overload the service, or try to reach data that is not yours.

Meet safely: tour in person or by live video before paying, bring someone or tell a friend where you are going, and pay in a way you can undo.

You own the photos, videos and words you post. You give Crash a non-exclusive, worldwide, royalty-free license to host, store, copy, resize, display and share them, only to run and show Crash (for example on listing pages, in search results, and in previews when someone shares a link), for as long as they are on Crash and for a short time afterwards while backups and caches clear.

Only post content you have the right to post. Do not post photos of other people without their permission.

A note on a request is seen only by you and the person you send it to. Messages in a chat are seen only by the two people in it. We do not read chats as a matter of course. We may look at a message that is reported to us, or when we need to for safety or because the law requires it.

You can report a listing, a person or a message, and block anyone. A person at Crash reads reports. We may remove content, limit what an account can do, or suspend or close an account when we believe it breaks these terms, puts someone at risk, or breaks the law. We try to explain why, unless doing so would put someone at risk.

We are not required to monitor what people post, and we may not act on every report. Crash limits how fast one account can send requests, messages or new listings, and refuses some words in public text, to keep spam and abuse down.

If you believe something on Crash infringes your copyright, email hello@crashmia.com with: your name and contact details; the work you own; the link to the material on Crash; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or allowed to act for the owner; and your physical or electronic signature.

If your content was removed and you believe that was a mistake, you can send us a counter-notice with the same kind of details. We close the accounts of people who infringe again and again.

If someone listed a place you own or manage without your permission, or used your photos, tell us at the same address or through our support page, and we take it down while we look into it.

We email you sign-in codes, the result of a review, notices about your listings, and, unless you turn them off on your profile, when someone sends you a request, accepts yours, or messages you. We never put the text of a message, a request note, or an address in an email.

You can delete your account at any time from your profile. Our delete-account page explains what is removed and what we keep. We may suspend or close an account as described above. Sections 8 (the license, for the short time stated), 13, 14, 15 and 16 keep applying after an account ends.

Crash is provided "as is" and "as available". We work hard to keep it running and safe, but we do not promise that it will always be available or free of mistakes, that any listing is accurate or still available, or that anyone you meet through Crash is who they say they are or will do what they say.

To the fullest extent the law allows, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Crash is not responsible for what users say or do, on Crash or off it, or for any lease, sublease, payment, deposit, damage, loss or dispute between users.

To the fullest extent the law allows, Crash is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost money, data, or opportunities, and our total liability to you for any claim is limited to one hundred US dollars (US $100). Nothing in these terms limits liability that the law does not allow us to limit.

If someone makes a claim against Crash because of something you posted, something you did on or through Crash, a deal you made with another user, or your breaking these terms or the law, you agree to cover Crash's reasonable costs of dealing with it, including legal fees, to the extent the law allows.

These terms are governed by the laws of the State of Florida and of the United States, without regard to rules about which law applies. Any court case about them or about Crash will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and Crash agree to those courts. Either of us may instead bring a claim in small claims court if it qualifies.

We may update these terms. The date at the top always shows the latest version, and for a change that matters we will tell you on the site or by email before it applies. If you keep using Crash after that, the new terms apply.

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce something straight away, we have not given up the right to. You may not transfer your account or these terms to anyone else; we may transfer them to a company that takes over running Crash. These terms and the Privacy Policy are the whole agreement between you and Crash about using it.
